AI Usage Policy

MARKO uses the following third-party AI providers to power its core features:

All AI processing occurs via API calls to OpenAI's infrastructure. No AI model is trained or fine-tuned on your data by the Company or OpenAI as a result of your use of the Service.

AI is used to generate the following types of content within MARKO:

• Social media captions — Thai and English captions tailored to your brand voice.
• Post topics — creative, brand-aligned topic suggestions for your content calendar.
• Campaign plans — structured multi-post content calendars for a marketing goal.
• Brand DNA — a descriptive summary of your brand personality, tone, and visual identity.
• Product descriptions — enriched product copy generated from your input.
• AI images — visuals generated from your brand and product context.

Each AI generation deducts credits from your account balance at the rates published on the Credits page of the platform.

To generate content, we send the following data to OpenAI's API on your behalf:

• Your brand DNA prompt (a summary of your brand voice, style, and identity).
• Product names, descriptions, and any attributes you have entered.
• Your selected post topic, platform, and tone preferences.
• Previous content context where you request regeneration.

We do not send to OpenAI: your name, email address, payment information, or any personal data beyond what is necessary for content generation.

Per OpenAI's API usage policies, data submitted via the API is not used to train OpenAI's models. OpenAI may retain API input/output for up to 30 days for safety monitoring only, after which it is deleted. See OpenAI's privacy policy for full details.

Content generated by AI through the MARKO platform using your inputs is assigned to you. You are free to use, edit, publish, and commercialize AI-generated captions, topics, campaign plans, and images in your business activities.

The Company does not claim ownership of, or any license to, AI-generated content produced specifically for your account using your brand data.

AI-generated images may contain elements derived from OpenAI's training data. You are responsible for ensuring that any AI-generated images you publish do not infringe third-party rights. We recommend reviewing images for brand safety before publication.

AI-generated content is produced probabilistically and may not always be accurate, factual, legally compliant, or appropriate for your specific context. Key limitations include:

• AI may generate content that contains factual errors, outdated information, or cultural inaccuracies.
• AI-generated captions may not perfectly reflect your brand voice without review and editing.
• AI images may contain imperfections, incorrect text rendering, or artifacts.
• Campaign plans are suggestions only and may require adjustment for your specific business context.
• AI-generated content has not been reviewed by legal, medical, financial, or other professional advisors.

You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing or distributing it. The Company accepts no liability for consequences arising from publishing AI-generated content without adequate review.

You must not use MARKO's AI features to generate content that:

• Is false, misleading, or deceptive — including fake news, fabricated testimonials, or fraudulent claims.
• Defames, harasses, or targets individuals or groups based on protected characteristics.
• Infringes intellectual property rights of third parties, including copyrighted text or trademarked names.
• Promotes illegal products, services, or activities under Thai or applicable law.
• Contains hate speech, explicit sexual content, or graphic violence.
• Impersonates real persons, organizations, or public figures.
• Violates Thai advertising laws, including the Advertising Standards B.E. 2522 and sector-specific rules.
• Constitutes unsolicited commercial communications (spam).

Generating prohibited content may result in immediate account suspension and reporting to relevant Thai authorities where required by law.

We believe in transparent use of AI. When using MARKO to publish social media content, you should consider whether applicable platform rules or industry guidelines in your sector require disclosure that content was AI-assisted. The Company does not automatically add AI-disclosure labels to published posts; this responsibility rests with you.

MARKO is designed as an AI-assisted platform, not a fully autonomous publishing system. All AI-generated content is surfaced to you for review before it is published. You retain full control over what is posted to your connected social accounts.

The Company does not publish content to your social accounts without your explicit action (manual publish or scheduled publish that you have approved).

By using MARKO's AI features, you also agree to comply with the usage policies of our AI providers, particularly OpenAI's Usage Policies. Key requirements include:

• Do not attempt to generate content prohibited under OpenAI's usage policies.
• Do not use AI-generated content to harm, deceive, or manipulate others.
• Do not represent AI-generated content as entirely human-authored in contexts where this distinction matters.

AI models and capabilities evolve rapidly. We may update the AI providers, models, or features used in MARKO. Material changes to how AI processes your data will be communicated via in-app notice or email before they take effect.
