These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Sixsheet Tech Co., Ltd. ("Company", "we", "us", "our"), a company registered in the Kingdom of Thailand, regarding your access to and use of MARKO, an AI-powered marketing platform ("Service").
MARKO is an AI-powered social media marketing platform that enables users to create, manage, and publish branded content including captions, campaign plans, and images. The Service is intended for businesses, marketers, and content creators operating primarily in Thailand and Southeast Asia.
The Service is provided on an as-is basis and features may be updated, modified, or discontinued at any time with reasonable notice to active users.
The Service operates on a credit-based model. Credits are the sole currency for consuming AI features within the platform.
You retain full ownership of all content you upload to the Service, including brand assets, product images, and descriptive text ("User Content").
By uploading User Content, you grant the Company a limited, non-exclusive, worldwide, royalty-free license to store, process, and use that content solely to provide the Service to you. This license terminates when you delete the content or close your account.
You represent and warrant that you hold all necessary rights, licenses, and permissions for any User Content you upload, and that such content does not infringe the intellectual property rights of any third party.
The MARKO platform, including its software, design, trademarks, and AI models (excluding third-party components), are the exclusive property of Sixsheet Tech Co., Ltd.
Content generated by our AI tools — including captions, campaign plans, topics, and images — is delivered to you for use in your marketing and business activities.
You agree not to use the Service to:
Violation of this policy may result in immediate account suspension or termination without refund.
The Service integrates with third-party platforms and services including Facebook, Instagram (Meta), and OpenAI. Your use of those integrations is governed by those providers' own terms of service and privacy policies. The Company is not responsible for the availability, accuracy, or policies of third-party services.
We aim to maintain high service availability but do not guarantee uninterrupted, error-free access. We may perform scheduled or emergency maintenance. Where possible, we will provide advance notice via in-app notification or email for planned downtime exceeding 30 minutes.
The Company is not liable for losses arising from service interruptions beyond our reasonable control, including force majeure events, third-party outages, or infrastructure failures.
By you: You may close your account at any time by contacting [email protected]. Remaining credits will be forfeited upon voluntary closure.
By us: We may suspend or permanently terminate your account without notice if you materially breach these Terms, engage in fraudulent activity, or cause harm to other users or the platform.
Upon termination, your access to the Service ceases immediately. Your data will be handled in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will meet your specific requirements, that results obtained from the Service will be accurate or reliable, or that defects will be corrected.
TO THE MAXIMUM EXTENT PERMITTED BY THAI LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR CREDITS IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Bangkok, Thailand.
We may update these Terms from time to time. Material changes will be communicated via email and/or in-app notification at least 14 days before taking effect. Continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms.
